Outside the US, your local consumer rights always apply (section 17).
1This agreement
In short: by playing our games you agree to these Terms. If you don't agree, please don't play.
These Terms of Use ("Terms") are a legal agreement between you and Daniel Bobunov, an independent developer in New Jersey, USA, who publishes games under the name Oversauced ("we", "us", "our"). They cover our games Meowcha Café, Cuddle Shop and Pom Pom Parade, any future game that links to them, their updates and in-game content, and this website (together, the "Games").
By downloading, installing or playing a Game, you accept these Terms and our Privacy Policy, which explains how we handle data. If you do not accept them, do not use the Games, and delete them from your device.
When you get a Game from Apple's App Store, these Terms are its end-user licence agreement. If Apple shows its Standard Licensed Application End User License Agreement for a Game instead, these Terms add to it, and Apple's agreement wins where the two conflict. Section 18 contains terms Apple requires.
Section 15 has a binding arbitration agreement and a class-action waiver for players in the United States. You can opt out within 30 days.
2Who can play
In short: you must be 13 or older. Under 18? A parent or guardian must agree to these Terms for you.
- You must be at least 13 years old (or older, if the law where you live sets a higher minimum age for using games like ours without a parent's consent). The Games are rated 13+ and are not made for children.
- If you are under 18, or under the age of majority where you live, your parent or legal guardian must read and accept these Terms for you, and is responsible for your use of the Games and for any purchases you make.
- You may not use the Games if the law forbids you from receiving them (see section 18).
3Your licence to play
In short: the Games are licensed to you for personal fun, not sold.
We give you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download, install and play the Games on Apple devices that you own or control, as allowed by Apple's Usage Rules (including Family Sharing), for your own non-commercial entertainment. The Games are licensed, not sold. Everything we do not expressly grant is reserved.
You may share screenshots and short videos of your own play for non-commercial purposes, as long as you don't suggest that we endorse you.
4Fair play: what you may not do
In short: please don't cheat, hack, copy or resell the Games. If you find a bug, tell us; we're grateful.
You agree not to, and not to help anyone else to:
- cheat, or use bots, mods, hacks, scripts or any unauthorized software to change how a Game works or to gain coins, items or progress, including by deliberately exploiting a bug or changing your device's clock to collect rewards;
- get paid items or remove ads without paying, or interfere with purchases, restores, ads or ad measurement (including fake ad views or clicks);
- copy, modify, translate, decompile, disassemble or reverse engineer a Game, or try to extract its source code or art, except where the law expressly allows this despite this restriction;
- rent, sell, lend, distribute or commercially exploit a Game, its content, or Virtual Items (section 5);
- break the law, infringe anyone's rights, or use a Game in a way that could harm us, other players or our partners' services;
- harass or abuse anyone who answers support emails, or pretend to be someone else.
If you find a bug or exploit, please report it instead of using it.
5Coins and other virtual items
In short: coins, boosters and other in-game items are a licence to use in the game. They have no real-world value, aren't your property, and can't be cashed out. Purchased coins never expire.
Virtual items have no real-world value. They are not your property. Purchases are non-refundable, except as required by law or as Apple decides under its refund policy.
- What they are. "Virtual Items" means coins, stars, lives, boosters, decorations, collectibles and any other in-game item or currency, and entitlements such as Remove Ads, whether you earn them by playing or get them with a purchase.
- A licence, not property. You get a limited, personal, non-transferable, non-sublicensable, revocable licence to use Virtual Items in the Game they belong to. You do not own Virtual Items, they are not your property, and no title to them passes to you.
- No real-world value. Virtual Items have no monetary value. They cannot be exchanged for real money, goods, services or anything else of value, from us or anyone else, and cannot be sold, traded, gifted or transferred outside the Game. We never buy them back. Selling or buying Virtual Items or progress outside the Game breaks these Terms.
- No refunds from us. All purchases are final and non-refundable, except as required by applicable law or as Apple decides under its refund policy. If a purchase is refunded or charged back, the Virtual Items it gave may be removed, even if that makes a coin balance negative.
- Our promises. Purchased coins never expire. Every player pays the same price. Nothing we sell is random. We may rebalance things earned in play (for example how many coins a level gives, or what an item costs in coins), but while a Game is available we won't take away or reduce Virtual Items you paid for, except under section 5.4 or section 11.
- They live on your phone. Coins and progress are stored on your device. If you delete a Game or lose your phone, they can be lost, and Apple's Restore Purchases brings back one-time purchases (like Remove Ads) but not coins. If you lose Virtual Items because of a bug in our Game, write to us and we will put things right where we reasonably can.
- If a Game ends. If we stop offering a Game, we will try to give at least 30 days' notice in the Game and stop selling Virtual Items at once. You can use the ones you have until the end. Unused Virtual Items are not refundable unless the law requires it.
6Purchases, prices and refunds
In short: everything is bought through Apple, and Apple handles refunds.
- All purchases are made through Apple's App Store with your Apple ID and are subject to Apple's Media Services Terms and Conditions. We never see your payment details.
- Apple shows the price in your currency, including any tax it collects, before you confirm. What a purchase contains is shown before you buy.
- Refunds are decided by Apple: reportaproblem.apple.com (Apple's refund guide). We cannot issue App Store refunds ourselves.
- Parents: you are responsible for purchases made by your children. Apple's Ask to Buy and Screen Time let you approve or block them.
- If something you paid for did not arrive, use Settings → Privacy & purchases → Restore purchases, then contact us (section 21).
7Ads and third-party content
In short: the Games show ads from other companies. We limit them to PG and act on reports, but we don't control or endorse what they advertise.
The Games are free because they show ads, served by third-party ad networks (listed in the Privacy Policy). Ads and the apps, websites and offers they lead to are provided by those third parties under their own terms; we do not control or endorse them and are not responsible for them. We set the maximum ad content rating to PG and remove ads reported as inappropriate where we can (Settings → Privacy & purchases → Report an ad). Reward videos only play when you choose to watch one. Remove Ads turns off ads between levels and the banner, not optional reward videos.
Parts of the Games rely on third-party services (Apple, Google, AppLovin, Unity, RevenueCat). You agree to follow any third-party terms that apply when you use them, such as your mobile carrier's terms for data use.
8Your ideas and feedback
We love hearing ideas. If you send us suggestions, ideas or feedback about the Games, you agree that we may use them freely, for any purpose, without paying you or crediting you, and you grant us a perpetual, worldwide, royalty-free, irrevocable licence to do so. Please don't send anything you consider confidential or that belongs to someone else. Your emails themselves stay private under our Privacy Policy.
9Who owns what
The Games and everything in them (code, art, characters, names, logos, music, sounds, text and design) belong to us or our licensors and are protected by copyright, trademark and other laws. Meowcha Café, Cuddle Shop and Pom Pom Parade and Oversauced are our trademarks. These Terms give you no rights in them other than the licence in section 3.
10Changes to the Games, and if a Game ends
In short: games change and grow. We may update or retire them, and will warn you where we can.
We may update, change, add or remove levels, features, Virtual Items, prices and content at any time, and some updates may be needed to keep playing. We do not promise that a Game, or any feature, will always be available, work on every device, or be free of errors. We may stop offering a Game or this website, in whole or in part; where a Game sells Virtual Items, we will try to give at least 30 days' notice in the Game (section 5).
11Suspension and termination
You can stop at any time by deleting the Games. We may suspend or end your licence, and stop delivering or restoring purchases to you, if you seriously or repeatedly break these Terms (for example cheating, fraud, or abusing refunds or chargebacks), or if the law requires it. Where it is reasonable, we will tell you why. Sections 5, 8, 9 and 12 to 20 continue after these Terms end.
12Disclaimer of warranties
In short: we work hard on the Games, but they come as they are, without promises the law lets us leave out.
To the fullest extent permitted by law, the Games are provided "as is" and "as available", with all faults and without warranties of any kind, express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, quiet enjoyment and non-infringement. We do not warrant that the Games will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that saved progress or Virtual Items will never be lost.
Some places do not allow some of these exclusions, so some may not apply to you. Your rights as a consumer under the law where you live are not affected (section 17).
13Limits on our liability
In short: if something goes wrong, our liability is capped at what you paid us in the last 12 months, or US$50 if that is more.
To the fullest extent permitted by law: (a) we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, Virtual Items or progress, however caused, even if we were told they were possible; and (b) our total liability to you for all claims about the Games or these Terms is limited to the greater of the amount you paid for the Games and Virtual Items in the 12 months before the claim arose, or US$50.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence. Some places do not allow some of these limits, so they apply only as far as the law allows.
14Indemnity
To the extent the law allows, you agree to defend, indemnify and hold us harmless from third-party claims, losses and reasonable costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Games. This does not apply to consumers where the law does not allow it.
15Disputes: talk to us first, then individual arbitration (US players)
In short: if you live in the US and we disagree, first write to us; most things get solved. If not, a neutral arbitrator decides, one person's case at a time, not a court, jury or class action. Small-claims court stays open, and you can opt out within 30 days.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
- Who this applies to. This section applies if you live in the United States. It does not apply to players who live elsewhere (section 17).
- Talk to us first. Before starting arbitration, you and we each agree to send the other a written Notice of Dispute: your name, the Game, what happened and what you want. Send yours by email (section 21). We will send ours to the email you used to contact us. We both then try in good faith to settle it for 60 days. This step is required, and time limits are paused while it runs.
- Agreement to arbitrate. Any dispute, claim or controversy between you and us arising out of or relating to these Terms, the Games, Virtual Items, purchases, ads or our privacy practices (a "Dispute") will be resolved by binding individual arbitration, not in court, except as section 15.5 allows. The Federal Arbitration Act governs this section. The arbitrator decides questions about the scope and enforceability of this agreement to arbitrate, except that a court decides disputes about sections 15.6 and 15.7.
- How arbitration works. The American Arbitration Association ("AAA") administers it under its Consumer Arbitration Rules. If the AAA is unavailable, we will agree on another provider, or a court will appoint one. Fees follow the AAA consumer fee schedule, under which the business pays most of the costs; we will not seek our legal fees from you unless the arbitrator finds your claim frivolous. Hearings take place by video or phone, on written submissions, or in person in the county where you live. The arbitrator can award the same individual relief a court could, but only to you and only as needed for your claim. Judgment on the award may be entered in any court with jurisdiction.
- Exceptions. Either of us may bring an individual claim in small-claims court if it qualifies. Either of us may ask a court for an injunction to stop infringement or misuse of intellectual property (for example cheating tools or copied Games).
- No class actions, no jury. You and we may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative action or arbitration. The arbitrator may not combine more than one person's claims. YOU AND WE BOTH WAIVE ANY RIGHT TO A JURY TRIAL. If a court decides that any part of this section 15.6 cannot be enforced for a particular claim or form of relief (such as public injunctive relief), that claim or relief (and only that) is decided in court under section 16, after the individual arbitration ends.
- Mass filings. If 25 or more similar Disputes are brought against us by or with the help of the same or coordinated lawyers, they will be administered under the AAA's rules for mass arbitrations and may be filed and decided in batches of up to 50, with time limits paused for Disputes waiting for their batch. This is to keep everyone's claims moving fairly and affordably.
- 30-day right to opt out. You can opt out of this section 15 by emailing us (subject "Arbitration opt-out") within 30 days after you first accept these Terms. If you played a Game before October 20, 2026, you have 30 days from that date. Include your name, the Game(s) and a clear statement that you opt out. Opting out does not affect anything else in these Terms or your relationship with us.
- Changes to this section. If we change this section, the change won't apply to a Dispute already notified. You can reject a material change by emailing us within 30 days of it, and the previous version will keep applying to you.
- Time limit. To the extent the law allows, a claim must be started within one year after it arose, or it is permanently barred.
16Governing law and venue
These Terms are governed by the laws of the State of New Jersey and applicable United States federal law (including the Federal Arbitration Act), without regard to conflict-of-law rules. Any Dispute that is not arbitrated (because you opted out, or because section 15 allows court) must be brought only in the state or federal courts located in the State of New Jersey, and you and we consent to the personal jurisdiction of those courts. This section is subject to section 17 if you live outside the United States.
17If you live outside the United States
In short: your local consumer rights always apply, and you can use your local courts.
If you live in the European Union, the EEA, the United Kingdom, Switzerland or another country with mandatory consumer protection, nothing in these Terms takes away the rights you have under the laws of the place where you live. In particular: section 15 (arbitration and class-action waiver) does not apply to you; you may bring claims in the courts where you live; and sections 12 to 14 apply only as far as your local law allows. We remain responsible for loss you suffer that is a foreseeable result of our breach of these Terms or our lack of reasonable care, and we never limit liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Apple's terms explain your right of withdrawal for App Store purchases of digital content.
18Terms Apple requires
If you got a Game from Apple's App Store, you and we both acknowledge and agree that:
- Apple is not a party. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the Games and their content. These Terms do not allow any use of the Games that conflicts with Apple's Media Services Terms and Conditions.
- Scope of licence. Your licence is non-transferable and limited to using the Games on Apple-branded products you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the Games may be accessed by other accounts associated with you through Family Sharing.
- Maintenance and support. We alone are responsible for maintenance and support (section 21). Apple has no obligation at all to provide any maintenance or support for the Games.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If a Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for that Game to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the Games, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility (subject to sections 12 and 13).
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the Games or your possession or use of them, including product liability claims, claims that a Game fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that a Game or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and contact. Questions, complaints or claims about the Games go to us: Daniel Bobunov (publishing as Oversauced), by email () or in the game under Settings → Help & support.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the Games (for example your wireless data service agreement).
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
19Changes to these Terms
We may update these Terms, for example when the Games or the law change. We will change the "Last updated" date, and for material changes we will tell you in the Game or on this page before they take effect. If you keep playing after a change takes effect, you accept the new Terms; if you don't agree, stop playing and delete the Games. Changes to section 15 follow section 15.9.
20General terms
- Entire agreement. These Terms, the Privacy Policy and any rules shown in a Game are the entire agreement between you and us about the Games and replace any earlier agreement on the same subject.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and that part is enforced as far as it can be (except as section 15.6 says).
- No waiver. If we don't enforce a right, we have not given it up.
- Transfer. We may transfer these Terms to a company we control (for example if we form one to publish the Games) or to a successor who takes over a Game, as long as your rights are not reduced. You may not transfer your rights under these Terms.
- Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
- Summaries. The "In short" notes and "At a glance" box help you read these Terms. If they differ from the full text, the full text applies. If we translate these Terms, the English version controls where the law allows.
